Criminal defense.

On television, a criminal case is seldom resolved until both the prosecution and the defense take the matter all the way to trial.  In real life, Attorney Powers is confident and ready to go to trial, but understands from years of experience in the criminal courts that persuasive negotiation can achieve many results faster and more reliably.

Beyond trial skills, Kevin brings to every case his vast experience arguing appeals. When Attorney Powers argues a motion to suppress evidence seized by the police, a motion to dismiss your case, or a motion to get vital evidence held by someone else, he brings a sophisticated and nuanced approach to legal writing and research.  He has an understanding of how to write the arguments that frequently sway judges, and he is prepared to find the right law to support those arguments. Personal injury.

When you are injured on the road, while at a store or restaurant, or elsewhere in your daily life, you have enough to deal with in taking care of your injuries and receiving adequate medical treatment. Your time is best spent focusing on your recovery, not worrying about how to ensure that the insurance company compensates you for your loss.

Attorney Powers takes on personal injury cases in order to take the pressure, the stress, the negotiation, and the litigation off of your shoulders. Kevin not only draws upon years of experience in representing personal injury victims in claims and civil suits against insurance companies; he also draws upon years of experience prosecuting insurance fraud criminal cases. This comprehensive insurance litigation background has given Attorney Powers insight into and understanding of the concerns that insurance companies, insurance claims representatives, insurance adjusters, insurance investigators, and insurance litigators focus on.

​Juvenile rights and child welfare litigation.

When a child is accused of breaking the law, or when a parent is deprived of parental rights by the Department Of Children And Families, the entire family suffers. Representing parents or children is a sensitive area of litigation that requires an acute understanding of the family dynamics that are involved, of the complicated procedural steps that ensue, and of the numerous statutes and regulations that govern the process.

Attorney Powers has handled numerous Care And Protection cases and is thoroughly familiar with this area of the law. He possesses a deep understanding of both the relationships at stake in juvenile rights litigation, and the legal issues that control whether a family can be deprived of parental rights and whether a child is adopted against the wishes of his or her parents.

Business litigation.

Litigating disputes between members of a business or between multiple businesses requires an understanding of the laws that govern shareholder disputes, of the laws that govern tort, contract, and fiduciary relations claims between business entities, and of the multiple venues available for resolving disputes of this nature.

While a skilled litigator must never be afraid to go into court when necessary, the most skilled litigators also understand the range of alternative dispute resolution tools that are available to bring litigation to an end sooner rather than later. We have experience with, and understanding of, mediation and arbitration. ​Consumer protection / Chapter 93A litigation.

When you are a consumer and feel that you have been wronged by a business, you not only lose confidence in the business that wronged you, but you also lose confidence in yourself as a consumer and in the entire business world. Wrongs and scams committed against consumers, by increasing the cost of business for the rest of the business world, make it difficult for honest consumers and honest businesses to do business.

Attorney Powers draws on a vast experience processing white collar crime, credit card fraud, check fraud, embezzlements, and business scams to represent clients in consumer protection litigation pursuant to Massachusetts Chapter 93A, the Massachusetts Consumer Protection Act.

Kevin offers a candid assessment of an alleged consumer protection violation: is your situation viable as a Chapter 93A claim? If so, Attorney Powers can apply the skilled pen of an appellate advocate who has written numerous briefs to crafting a thorough, articulate, and persuasive Chapter 93A demand letter. Construction litigation.

Construction projects are complicated, and each entails a multitude of interwoven relationships between owners, general contractors, subcontractors, architects, engineers, surety companies, insurance companies, lenders, and borrowers. Attorney Powers has litigated construction cases involving commercial projects, state contract projects, and residential projects. Kevin has represented general contractors, subcontractors, architects, and owners. With his well-trained eye for detail, he is particularly suited to understanding and navigating the complex web of roles, responsibilities, and personalities that construction litigation almost inevitably entails. In addition, Kevin also brings to any case his experience and background in municipal government, which provided him with first-hand insights into construction and finance issues in the context of a major commercial casino proposal, a large town library project, multiple school renovation projects, and the building of new municipal recreational facilities. By pairing multi-faceted insight from a range of construction disciplines with a sharp and careful legal insight, Attorney Powers is well-suited to handle construction litigation from many angles.

Handling the tenuous and sensitive interactions between businesses and employees is as much an art as crafting a carefully-worded appellate brief.  Attorney Powers is familiar with the rights and options available to both employers and employees.  His experience with wage, tips, and overtime statutes, discrimination law, and the law governing classifications of employees and independent contractors allows Kevin to apply insight tempered with care to business interactions.  Whether a difficult employment situation should be dealt with through a relatively cordial negotiation, a settlement agreement, an administrative proceeding before a government agency, or a civil action in court is a key tactical decision, and Attorney Powers takes care in these situations to advise with sensitivity and attention.
